If the project scope changes, pricing and timelines may also change.
A project only begins after:

- Payment terms are accepted
- Required deposit or payment is made
- Required project materials are provided
- Payments
Payment terms will be stated in the project proposal, invoice, or agreement.
Unless otherwise agreed:
- A deposit may be required before work begins
- Full payment may be required before final handover
- Monthly retainers are paid in advance
- Late payments may delay project delivery
- Work may be paused if payments are overdue
All prices are subject to scope, complexity, integrations, and timeline.
- Refunds
Payments made for completed work, booked time, strategy, consultation, design, development, setup, or digital services are generally non-refundable.
If a project is cancelled before completion, any refund or balance will depend on the amount of work already completed, time spent, and costs incurred.
- Client Responsibilities
To complete a project successfully, the client must provide required materials on time.
This may include:
- Business information
- Logo and brand assets
- Website content
- Images or media
- Login details where needed
- Payment provider details
- Product or service information
- Feedback and approvals
Delays in providing materials, feedback, or approvals may delay the project timeline.
- Project Timelines
Project timelines are estimates unless clearly stated otherwise.
Timelines may change due to:
- Delayed client feedback
- Missing content or materials
- Changes in project scope
- Third-party plugin or hosting issues
- Payment delays
- Technical complications
We aim to communicate clearly if delays occur.
- Revisions
Projects may include a specific number of revisions depending on the package or agreement.
Extra revisions, major changes, or changes outside the original scope may attract additional charges.

The client is responsible for paying any third-party fees unless otherwise agreed.
Njinway is not responsible for changes, downtime, pricing changes, or limitations caused by third-party services.
- Hosting and Domain Names
Unless included in the project agreement, hosting and domain registration are the client’s responsibility.
We may guide or assist with setup, but the client should maintain ownership and access to their domain and hosting account.
- Content and Materials
The client is responsible for ensuring they have the right to use any content, images, logos, videos, documents, or materials provided to Njinway.
Njinway is not responsible for copyright issues caused by client-provided materials.
- Portfolio Use
Unless agreed otherwise, Njinway may display completed work in our portfolio, website, social media, proposals, or marketing materials.
This may include screenshots, project descriptions, business name, and public website links.
If a client does not want their project shown, they should inform us in writing.
- Intellectual Property
Once full payment is received, the final approved website or project deliverables are handed over to the client, except for third-party tools, plugins, themes, stock assets, or licensed materials.
Njinway retains the right to reuse general knowledge, methods, workflows, code patterns, design ideas, and processes developed during the project.
- Website Maintenance
After project handover, the client is responsible for website updates, backups, security, content changes, and maintenance unless they are on an active maintenance or retainer plan with Njinway.
If the client or another provider changes the website after handover, Njinway is not responsible for issues caused by those changes.
- SEO and Results
We may provide SEO setup, structure, and improvements designed to support online visibility.
However, we do not guarantee specific search rankings, traffic numbers, leads, sales, or revenue results.
Search performance can be affected by competition, content quality, industry, website activity, search engine changes, and other factors outside our control.
- Payment Integrations
We may assist with payment gateway setup or integration.
The client is responsible for:
- Having a valid payment provider account
- Providing correct business details
- Meeting provider requirements
- Handling transaction fees
- Following applicable laws and tax obligations
Njinway is not responsible for declined applications, payment provider downtime, transaction disputes, or payment gateway policy changes.
- Limitation of Liability
Njinway will not be liable for indirect losses, loss of profits, loss of business, data loss, downtime, third-party failures, or damages caused by factors outside our control.
Our total liability for any project shall not exceed the amount paid to Njinway for that specific service.
- Confidentiality
We respect client confidentiality.
Any private business information shared with us will be used only for the purpose of providing the agreed service, unless permission is given or disclosure is required by law.
- Termination of Services
Either party may end a project or service agreement by written notice.
If a project is terminated, the client is responsible for payment for work already completed, time spent, and any costs incurred up to the termination date.
- Changes to These Terms
We may update these Terms & Conditions from time to time.
Updated terms will be posted on this page.
Continued use of our website or services means you accept the updated terms.
